3. Service Description (No Legal Advice)
PatentDock provides tools to help prepare patent materials (questionnaires, prior‑art search, qualitative scoring, claims drafts) and collaboration features. We are not a law firm and do not provide legal advice. Outputs (including AI‑generated content) are for informational purposes only and must be reviewed by qualified counsel. No attorney‑client relationship is formed.
4. Accounts; Organizations; Roles
You must be 18+. Authentication is via third‑party identity provider (e.g., Clerk). Users may belong to organizations with roles (e.g., Admin, Inventor, Lawyer). Admins may manage memberships. You’re responsible for account security and all activity under your account.
5. User Content and License
You retain ownership of content you submit (invention details, questionnaires, attachments, claims, notes). You grant us a worldwide, non‑exclusive license to host, process, transmit, and display such content solely to provide and improve the Service, including AI‑assisted features. You represent you have rights to submit content and that it does not infringe third‑party rights.
6. AI and Third‑Party Services
We may send limited content to model providers (e.g., OpenAI via Vercel AI SDK) to generate outputs. According to OpenAI, API data is not used to train OpenAI models by default. We also use identity/auth (Clerk) and payments (Polar). See Privacy Policy. We do not guarantee correctness, originality, or freedom‑to‑operate of AI outputs.
7. Payments; Credits; Refunds; Taxes
- Credits. Certain actions (e.g., creating/reactivating patents) consume credits. Credits are minted upon confirmation of payment events and expire one (1) year after purchase.
- Consumption. Creating a new patent or reactivating a lapsed patent consumes a credit immediately and permanently.
- Refunds. No refunds after payment. Consumed and unconsumed credits are non‑refundable. In the event of a chargeback or an exceptional refund that we process at our discretion, unconsumed credits may be revoked.
- Pricing & Taxes. Prices may change; applicable taxes are your responsibility.
- Chargebacks. We may suspend/terminate accounts for chargebacks or suspected fraud/abuse.
- Processor. Payments are processed by Polar/its underlying processors; we do not store full card data.
8. Acceptable Use
You will not violate laws, IP, or privacy rights; submit unlawful/confidential third‑party information without permission; bypass security; scrape, reverse engineer, or misuse rate limits; or upload malware.
9. Confidentiality
We protect your non‑public content as confidential and use it only to provide the Service, except as required by law or with your consent.
10. Intellectual Property; Feedback
The Service, documentation, and our marks are our IP. Feedback may be used to improve the Service without obligation.
11. Disclaimers
THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS”. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS ARE ERROR‑FREE, NOVEL, NON‑OBVIOUS, OR PATENTABLE.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE EVENT OR USD $100 (OR EQUIVALENT), WHICHEVER IS GREATER.
13. Indemnification
You will defend and indemnify us against claims arising from your content, your use in violation of these Terms or law, or your infringement of third‑party rights.
14. Term; Suspension; Termination
We may suspend or terminate access (with or without notice) for violations, risk, or non‑payment. Sections intended to survive (e.g., 5, 9–13) will survive.
15. Modifications
We may update these Terms. Material changes will be effective upon posting or as stated. Continued use signifies acceptance.
16. Governing Law; Disputes
Governing law: India. Venue: Gurugram, Haryana. Optional arbitration may be adopted upon notice.
17. Export; Sanctions
You represent you are not prohibited from receiving the Service under applicable export/sanctions laws.
